Big 12 and Big East in limbo waiting on WVU

Eight months from now West Virginia may be playing as a member of the Big 12 conference, or it may still be a member of the Big East. Right now, we don't really know, and if you ask West Virginia's athletic director, Oliver Luck, he's not going to be of much help.

"I can't help much," Luck told The Charleston Gazette when asked. "I'm sworn to secrecy ... I'm not going to comment. My silence is all I can offer." 

This is because the situation is currently being handled by the courts. West Virginia would like to leave, but the Big East is holding the school to its contract, and until some type of settlement is reached, both the Big 12 and Big East remain in limbo. Which is causing headaches for both conferences, as The Oklahoman's Berry Tramel went over earlier this week when discussing the Big 12's scheduling problem. While Tramel's focus was on the Big 12, the Big East is facing similar problems with its schools not knowing whether West Virginia will still be on their schedules or not.

In both the Charleston Gazette story and Tramel's story, the prevailing theory is that whether the case is settled or not -- and I'd put money on it not being -- West Virginia is going to jump to the Big 12 in time for the next school year and then just suffer the consequences of that decision. Consequences that could end up costing the school quite a bit of money.

This is because even if there was a decision made in the courts on the case, the "losing" side would appeal the decision, and that appeal could take another couple of years to be settled. Another couple of years West Virginia isn't likely to sit around waiting for a decision on.

It seems like the Big 12 could put a stop to this.  Just threaten the Big East that they will invite Louisville, Cincy, USF or whoever immediately if they don't drop the lawsuit against WVU.

I have a far-out suggestion for my alma mater:  Should the court, based in R. I. where the B.E. is headquartered, rule against the university's early departure, just join the Big XII anyway.  Invite 3 dozen walk-ons with HS FB experience to join the team (or take the bottom 30-36 players from the 105-player squad) and have them suit up for Big East games; offer to play all Big East games on the road.  Play the double schedule (who knows; they could finish in line to play in two bowls at the end of the season); the Big XII might give WVU an extra home game as a favor.  In fact, WVU will be expecting tougher competition in the Big XII, so a single squad could play 3 or 4 games against Big East teams as Big XII non-congames to begin the season.  In effect, by doing this, WVU could show as much respect for what the league has become as the Big East commissioner has shown to Big East FB all along.

Its all the BE fault anyway! Had they taken a stand to begin with or show half of the ball sack they are pretending to show now they wouldnt have anything to worry about. No they would rather protect the BBall schools and ND then cry when a team says I refuse to play in this league anymore. The BE is simply getting what it had coming for protecting the before mentioned for as long as they did. GO EERS and GOOD LUCK IN BIG12!

I'd be really curious to hear from the Boise State folks on this issue.  Does Boise want this crap resolved now so they can begin play right away?  I'd imagine they'd want a couple seasons in while there is still an AQ for the Big East.  Once  Louisville and Cincy get picked, it's done.

I don't see how there would be a basis for the Big East to sue the Big XII.  All they did was invite one school from another conference to their conference.  How does one litigate that?  Now if there was some sort of agreement between the Big East and the Big XII prior to the invite that they would never invite each other schools to their respective leagues, or would only do so with XX amount of warning, then maybe they could sue based on that.  But I don't see any basis for one conference suing another for inviting a team in. It was no secret the Big XII was looking to expand, and was looking at several schools among them WVU.  Big Sleasy leadership also knows they're likely to get poached again for Louisville or Cincinnatti.  Right now they're just bowing their backs trying to show how tough they are going to be on anyone leaving.  As SMURPH posted, it's all gesturing and posturing.  The end result will be money paid. And we all know there's plenty of that to go around in FBS.

The Big East suing the Big 12 would be a losing battle.  Way too much money in the Big 12.  Although I could see some legal posturing (ie legal threats) and I really don't think that the Big 12 wants to be involved in either.  On the bright side though for the Big East, these kinds of moves are likely to make Louisville and Cincy less attractive to the Big 12.

Based on Luck's and the Big-12 commissioner's contention they will play in the Big-12 in 2012,  I am guessing they have a handshake agreement there..  As JoMountaineer, it seems highly unlikely a higher court would uphold a court order forcing a state sponsored school to play football or other sports against specific teams.   There will be a financial settlement at some point.  BE hierarchy has consistently been pretty stupid,  I can't fathom they are stupid enough to make WVU play in the BE in 2012-13.   They want two things.  1. Maximum amount of money.  2. To make it as difficult as possible.

Jesterace......... I agree with your posting and sounds pretty much the way it is right now.  With regards to the BIGXII Conference and their adamant stand that they would not let Texas A&M and Missouri leave for the SEC until the BIGXII was given assurances they would not be sued for anything.  Now, What do think the BIGXII position is now about WVU coming in next year, and possibly a lawsuit be lodged aganist the BIGXII conference by the BIG EAST and it's member schools ?  I had a reliable law person tell me that the BIGXII would prefer not having any exposure out there that would directly tie them with a lawsuit.  Interesting, what is your take on this ?

Finally a reporter writes what i have said all along. Hell we know the WV court will rule for WVU and the Rhode island court will rule for the Big East. And like the article said both will get appeal with the loser. In the mean time, WVU will get a injunction from the WV court to play in the Big 12 and i don't think a court in Rhode island would have the power to stop WVU from moving to the Big 12 for 2012. To sue WVU for damages yes, but to stop us from joining no. I would say if they do not come to a agreement this will end up in a federal court in about 3-4 Years.

A couple of reasons why the Big East is doing this:

1) To hold on to WVU until the new teams come on board

2) To send a clear message to the remaining Big East members and other conferences who would try to poach what is left of their teams, that it is going to be quite an expensive and/or a long and dragged out affair for teams to leave the Big East.
